The parade of lawsuits filed against Randy Shaws Tenderloin Housing Clinic, the largest San Francisco city funded homeless housing provider, continues. This one at the self described ‘jewel of the SROs’ and is a Care not Cash hotel
a similar recent lawsuit (MCGarr v THC) was recently settled out of court for an undisclosed amount of money. Randy Shaw, who signs off on all the settlements, does not want anyone to know how much is being paid out for these lawsuits, which is likely becoming a significant percentage of the 24 million dollar budget the City of San Francisco allocates for Tenderloin Housing Clinic
The subject incident occurred at the Graystone Hotel in San Francisco, California, which is owned, operated, and managed by Tenderloin Housing Clinic INC. On the morning of September 17th, 2009, Plaintiff Thomas Peecher was assaulted violently and repeatedly by another tenant at the hotel, with a deadly weapon, causing him suffered severe personal injuries Police investigation revealed that the alleged assault was in retaliation against plaintiff because he had previously complained to the hotel manager about assailants drug dealing activities and drug use on premises
Plaintiff alleges that defendant Tenderloin Housing Clinic knew or should have known that a particular crime was imminent based on specific circumstances in the subject lawsuit. Plaintiff further alleges that defendant Tenderloin Housing Clinic failed to take reasonable measures to protect against foreseeable dangers to the plaintiff or it’s tenant. As a result, plaintiff suffered severe personal injuries including but not limited to the swollen cheek bone as well as post traumatic stress disorder syndrome
Further, Tenderloin Housing Clinic failed to follow it’s own internal rules, as well as city, state, and federal laws regarding the prohibition of drug use and sales on property it owns, operates and manages. Defendant Tenderloin Housing Clinic ignored numerous attempts by plaintiff to transfer him to another property it manages. Instead, plaintiffs assailant still lives at the Graystone and continues to threaten plaintiff with violence. Said conduct of defendant Tenderloin Housing Clinic created a dangerous condition at the property and destroyed plaintiffs entitlement to quiet environment of his tenancy and made the premises uninhabitable
