HANC Recycling Center and Native Plant Nursery Dodges Another Bullet Lawyer to Recreation and Parks Department “Take Your Marbles Home” Shoddy Paperwork Blamed For Latest Eviction Fiasco

The attempt to evict the Haight-Ashbury Neighborhood Council (HANC) Recycling Center and Native Plant Nursery took another unexpected turn today as HANC’s Lawyer, Robert De Vries, sent a letter to the Recreation and Parks Department asserting that the eviction notice given so far is illegal. (See attached )

The final paragraph of the thoroughly researched and well reasoned communication reads, “A private litigant, faced with these two valid defenses would do the math, pick up their marbles, and go home. One would hope that RPD, using taxpayer funds and resources, would do the same.”.

The new legal opinion gives the beleaguered recycling center until June 30th if no other solution can be found.

When asked about this latest turn of events, Ed Dunn, HANC Recycling Center and Native Plant Nursery Executive Director said, “its really not too surprising that they messed up the paperwork considering that the current General Manager of RPD is Phil Ginsburg and he was Gavin’s Chief of Staff (and therefore in charge of the City) when MGN was in Hawaii and the Cosco Busan hit the Bay Bridge, that response was a fiasco too! I even heard he called the SFPD to see if they were ready to evict us and they told him to call the Sheriff”.


Second Letter to RPD Commission
