Dear Mr. Katz:
Out of respect for your accomplishments, I made numerous changes to my home
page. I had hoped I had addressed your certified concerns, which seemed to
center around one hyperlink. I was not happy with how that conversation went
either, and I want to personally apologize for any pain to you or your family
that may have been caused by other's, thoughtless, comments.
It fittingly self-destructed, but I should have removed that link much sooner.
And I'm normally a strong first amendment supporter. By pretty good law, I,
as the provider/publisher of the link, am not libel for the contents. You may
have a legitimate case with the writer, but not with the publisher. Be that
as it may, I removed the link as an act of good will, and from my personal
distaste with it's contents.
Apparently you have other concerns. It is not and has never been part of this
website's mission statement to make money. In fact, I lose money. As the
page is setup, I'd hope it would motivate fans to get the bands music. When
I've done searches for Moby Grape CDs, I invariably find SF Sound. Mr. Katz, I
respectfully submit that I send customers your way.
I also looked at the page contents that are mine and found them to be
singularly clean and free of reference to you. This is so because I never had
your side of the story and felt uncomfortable printing only one side of a
story, so I hewed very close to what I know about the band and the music.
In short, Mr. Katz, I have thus far made one good faith effort to comply with
your requests, I'll make more as needed. There is no reason, as I've
demonstrated, to get nasty, is there? Share with me what you find damaging
about my page. What elements do you feel violate your rights and marks? What
and where are the disparaging comments? What can I do to address these
concerns. And please feel free to be as specific and precise as necessary.
I have nothing but the highest regard for your business acumen, and have never
questioned it. I can only believe that your criticisms will be useful and
appropriate. I look forward to your reply.
Sincerely,
Ben Burma

Ben:
I have tried to reach you by phone but the number listed is incorrect. Please
contact me so that we can talk about your continued use of the name Moby
Grape. You are now liable for willful damages.
