                This letter shall, serve as formal notice that Matthew Katz is the holder of the valid Service Mark
                to the name Moby Grape which was issued by the United States Patent and Trademark Office as
                Registration No. 1,886,382. This mark was first issued to Matthew Katz on September 9 1966
                and was last renewed for an additional 10 ycar period on March 28. 1995 (see attached).

                Your present use of the name Moby Grape on MobyGrape.com is a direct infringement of my
                rights in and to the name and is a violation of federal trademark law.  Your website dilutes my
                business goodwill. contains defamatory remarks as to my business acumen, contains links to
                defamatory remarks against myself and my family, and otherwise damages both my business and
                my business reputation. I hereby request that you immidiately cease and desist from such illegal
                use of the name Moby Grape.

                If I don not receive your immediate compliance with this request, I will be forced to use every
                available means to defend myself.
