In general, you are<br \/>\nlobbying when you state your position on specific<br \/>\nlegislation to legislators or other government<br \/>\nemployees who participate in the formulation of<br \/>\nlegislation, or urge your members to do so (direct<br \/>\nlobbying). In addition, you are lobbying when you<br \/>\nstate your position to the general public and ask the<br \/>\ngeneral public to contact legislators or other<br \/>\ngovernment employees who participate in the<br \/>\nformulation of legislation (grassroots lobbying).<\/p>\n<p>does THC do that?..through beyondchron?<\/p>\n<p>just an example>  <a href=\"http:\/\/www.beyondchron.org\/news\/index.php?itemid=2612\">We also worked with Assembly member Mark Leno to get state legislation passed in 2003 to exempt SRO&#8217;s from the state Ellis Act.<\/a><\/p>\n<p>or this> (+) Randy Shaw, Tenderloin Housing Clinic<br \/>\n&#8211;          Supports legislation<\/p>\n<p>from the <a href=\"http:\/\/www.sfgov.org\/site\/planning_page.asp?id=16096\">Planning Commision 2002<\/a><\/p>\n<p><!-- s9ymdb:201 --><img loading=\"lazy\" decoding=\"async\" width=\"696\" height=\"402\" style=\"border: 0px; padding-left: 5px; padding-right: 5px;\" src=\"\/blog\/uploads\/tac4.jpg\" alt=\"\" \/><\/p>\n<p>for the Mission Hotel component, one thing THC didn&#8217;t do was cooperate with anybody when the press got interested. Maybe now they&#8217;ll have to cooperate when it comes to the Board of Supes who authorized the master leasing hotel arrangement in the first place. Questions like:<br \/>\nhow many people were recently fired an why?..It wasn&#8217;t just Carlos Hernandez either, but nobody can get anybody from THC to talk. This secrecy in  a publicly funded institution is what is making people suspicious<\/p>\n<p>if there are audits of THC then why doesn&#8217;t THC make them public?<\/p>\n<p>In fact, according to the 990, THC is supposed to have filed a <a href=\"http:\/\/www.cultural-alliance.org\/pubs\/lobbying.htm\">IRS form 5768<\/a> with the IRS, but Guidestar doesn&#8217;t have that<\/p>\n<p>It&#8217;s supposed to be publicly available and Beyondchron should be posting it if they have nothing to hide<\/p>\n<p>the form 5768 reads, in part<\/p>\n<p>Section references are to the Internal<br \/>\nRevenue Code.<br \/>\nSection 501(c)(3) states that an<br \/>\norganization exempt under that section<br \/>\nwill lose its tax-exempt status and its<br \/>\nqualification to receive deductible<br \/>\ncharitable contributions if a substantial<br \/>\npart of its activities are carried on to<br \/>\ninfluence legislation. Section 501(h),<br \/>\nhowever, permits certain eligible<br \/>\n501(c)(3) organizations to elect to make<br \/>\nlimited expenditures to influence<br \/>\nlegislation. An organization making the<br \/>\nelection will, however, be subject to an<br \/>\nexcise tax under section 4911 if it<br \/>\nspends more than the amounts<br \/>\npermitted by that section. Also, the<br \/>\norganization may lose its exempt status<br \/>\nif its lobbying expenditures exceed the<br \/>\npermitted amounts by more than 50%<br \/>\nover a 4-year period. For any tax year in<br \/>\nwhich an election under section 501(h) is<br \/>\nin effect, an electing organization must<br \/>\nreport the actual and permitted amounts<br \/>\nof its lobbying expenditures and grass<br \/>\nroots expenditures (as defined in section<br \/>\n4911(c)) on its annual return required<br \/>\nunder section 6033. See Schedule A<br \/>\n(Form 990 or Form 990-EZ).
