Marijuana: possession.<br \/>\n   Existing law provides that, except as authorized by law, every<br \/>\nperson who possesses not more than 28.5 grams of marijuana, other<br \/>\nthan concentrated cannabis, is guilty of a misdemeanor and shall be<br \/>\npunished by a fine of not more than $100. <em> This same penalty is<br \/>\nimposed for the crime of possessing not more than 28.5 grams of<br \/>\nmarijuana while driving on a highway or on lands, as specified. <\/em><\/p>\n<p>Existing law provides <strike> for this offense <\/strike> <em> with<br \/>\nrespect to these offenses <\/em> that under specified conditions (1)<br \/>\nthe court shall divert and refer the defendant for education,<br \/>\ntreatment, or rehabilitation, as specified, and (2) an arrested<br \/>\nperson who gives satisfactory evidence of identity and a written<br \/>\npromise to appear in court shall not be subjected to booking.<br \/>\n   This bill would <strike> instead <\/strike> provide that <strike> ,<br \/>\nexcept as authorized by law, every person who possesses not more<br \/>\nthan 28.5 grams of marijuana, other than concentrated cannabis,<br \/>\n<\/strike> <em> any person who commits any of the above offenses <\/em><\/p>\n<p>is <em> instead <\/em> guilty of an infraction punishable by a fine<br \/>\nof not more than <strike> $250 <\/strike> <em> $100. This bill would<br \/>\neliminate the above- <\/em> <em> described prov <\/em> <em> isions<br \/>\nrelating to booking and to diversion and referral for education,<br \/>\ntreatment, or rehabilitation <\/em> . <strike> By changing the<br \/>\npenalties for an existing crime, this bill would impose a<br \/>\nstate-mandated local program. <\/strike> <strike><\/p>\n<p>   The California Constitution requires the state to reimburse local<br \/>\nagencies and school districts for certain costs mandated by the<br \/>\nstate. Statutory provisions establish procedures for making that<br \/>\nreimbursement. <\/strike> <strike><br \/>\n   This bill would provide that no reimbursement is required by this<br \/>\nact for a specified reason. <\/strike><br \/>\n   Vote: majority. State-mandated local program: <strike> yes<\/p>\n<p><\/strike> <em> no <\/em> .<\/p>\n<p>THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:<\/p>\n<p>  SECTION 1.  Section 11357 of the Health and Safety Code is amended<br \/>\nto read:<br \/>\n   11357.  (a) Except as authorized by law, every person who<br \/>\npossesses any concentrated cannabis shall be punished by imprisonment<br \/>\nin the county jail for a period of not more than one year or by a<br \/>\nfine of not more than five hundred dollars ($500), or by both such<br \/>\nfine and imprisonment, or shall be punished by imprisonment in the<br \/>\nstate prison.<br \/>\n   (b) Except as authorized by law, every person who possesses not<br \/>\nmore than 28.5 grams of marijuana, other than concentrated cannabis,<br \/>\nis guilty of an infraction punishable by a fine of not more than<br \/>\n<strike> two hundred fifty dollars ($250) <\/strike> <em> one hundred<br \/>\ndollars ($100) <\/em> .<br \/>\n   (c) Except as authorized by law, every person who possesses more<br \/>\nthan 28.5 grams of marijuana, other than concentrated cannabis, shall<br \/>\nbe punished by imprisonment in the county jail for a period of not<br \/>\nmore than six months or by a fine of not more than five hundred<br \/>\ndollars ($500), or by both such fine and imprisonment.<br \/>\n   (d) Except as authorized by law, every person 18 years of age or<br \/>\nover who possesses not more than 28.5 grams of marijuana, other than<br \/>\nconcentrated cannabis, upon the grounds of, or within, any school<br \/>\nproviding instruction in kindergarten or any of grades 1 through 12<br \/>\nduring hours the school is open for classes or school-related<br \/>\nprograms is guilty of a misdemeanor and shall be punished by a fine<br \/>\nof not more than five hundred dollars ($500), or by imprisonment in<br \/>\nthe county jail for a period of not more than 10 days, or both.<br \/>\n   (e) Except as authorized by law, every person under the age of 18<br \/>\nwho possesses not more than 28.5 grams of marijuana, other than<br \/>\nconcentrated cannabis, upon the grounds of, or within, any school<br \/>\nproviding instruction in kindergarten or any of grades 1 through 12<br \/>\nduring hours the school is open for classes or school-related<br \/>\nprograms is guilty of a misdemeanor and shall be subject to the<br \/>\nfollowing dispositions:<br \/>\n   (1) A fine of not more than two hundred fifty dollars ($250), upon<br \/>\na finding that a first offense has been committed.<br \/>\n   (2) A fine of not more than five hundred dollars ($500), or<br \/>\ncommitment to a juvenile hall, ranch, camp, forestry camp, or secure<br \/>\njuvenile home for a period of not more than 10 days, or both, upon a<br \/>\nfinding that a second or subsequent offense has been committed.<br \/>\n  <em> SEC. 2. <\/em>  <em> Section 23222 of the <\/em> <em> Vehicle<br \/>\nCode <\/em> <em> is amended to read: <\/em><\/p>\n<p>   23222.  (a) No person shall have in his or her possession on his<br \/>\nor her person, while driving a motor vehicle upon a highway or on<br \/>\nlands, as described in subdivision (b) of Section 23220, any bottle,<br \/>\ncan, or other receptacle, containing any alcoholic beverage which has<br \/>\nbeen opened, or a seal broken, or the contents of which have been<br \/>\npartially removed.<br \/>\n   (b) Except as authorized by law, every person who possesses, while<br \/>\ndriving a motor vehicle upon a highway or on lands, as described in<br \/>\nsubdivision (b) of Section 23220, not more than one avoirdupois ounce<br \/>\nof marijuana, other than concentrated cannabis as defined by Section<br \/>\n11006.5 of the Health and Safety Code, is guilty of <strike> a<br \/>\nmisdemeanor and shall bepunished <\/strike> <em> an infraction<br \/>\npunishable <\/em> by a fine of not more than one hundred dollars<br \/>\n($100). <strike> Notwithstanding any other provision of law, if the<br \/>\nperson has been previously convicted three or more times of an<br \/>\noffense described in this subdivision during the two-year period<br \/>\nimmediately preceding the date of commission of the violation to be<br \/>\ncharged, the previous convictions shall also be charged in the<br \/>\naccusatory pleading and, if found to be true by the jury upon a jury<br \/>\ntrial or by the court upon a court trial or if admitted by the<br \/>\nperson, Sections 1000.1 and 1000.2 of the Penal Code are applicable<br \/>\nto the person, and the court shall divert and refer the person for<br \/>\neducation, treatment, or rehabilitation, without a court hearing or<br \/>\ndetermination or the concurrence of the district attorney, to an<br \/>\nappropriate community program which will accept the person. If the<br \/>\nperson is so diverted and referred, the person is not subject to the<br \/>\nfine specified in this subdivision.
